Acceptance of Terms

By accessing or using Trough ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

Description of Service

Trough is a meal planning application that allows you to:

  • Create and manage recipes
  • Plan weekly meals for your household
  • Generate shopping lists from your meal plans
  • Track pantry inventory
  • Import recipes from external websites
  • Connect to third-party grocery services for ordering

Account Registration

To use certain features of the Service, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You must be at least 18 years old to create an account. By creating an account, you represent that you are at least 18 years of age.

User Content

You retain ownership of any content you create or upload to the Service, including recipes, meal plans, and shopping lists ("User Content"). By using the Service, you grant us a license to store, display, and process your User Content solely for the purpose of providing the Service to you.

You are solely responsible for your User Content. You represent that you have all necessary rights to the content you upload and that your content does not infringe on any third party's intellectual property or other rights.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is harmful, offensive, or infringes on others' rights
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its servers
  • Use automated means to access the Service without our permission
  • Resell or redistribute the Service without authorization

Third-Party Services

The Service integrates with third-party services to enhance your experience:

  • Instacart: When you use the "Shop with Instacart" feature, your shopping list data is shared with Instacart to facilitate grocery ordering. Your use of Instacart is subject to Instacart's own terms of service and privacy policy.
  • Authentication Providers: Google Sign-In and Apple Sign-In are used for account authentication, subject to their respective terms and policies.
  • Open Food Facts: Product information from barcode scanning is provided by Open Food Facts database.

We are not responsible for the availability, accuracy, or practices of third-party services. Your interactions with third-party services are governed by their respective terms and policies.

Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Trough and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Nutritional Information: Any nutritional information provided by the Service is for informational purposes only and should not be considered medical or dietary advice. We do not guarantee the accuracy of nutritional calculations. Always consult with a healthcare professional for dietary guidance.

Recipe Content: Recipes imported from external websites are provided as-is. We do not verify the accuracy, safety, or suitability of imported recipes. Always use your own judgment when preparing food.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TROUGH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Trough and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time through the Service settings.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
